Can the COVID-19 vaccine be required to return to work in person?

Currently, the Government of the Dominican Republic is carrying out the Covid 19 Vaccination Plan, which has brought into discussion whether or not it is mandatory for a person to be vaccinated against the virus, unleashing a conflict between the right to personal integrity and the right to the health of others and, extrapolating this situation to labor law, the question arises as to whether a worker can be fired for refusing to be inoculated with the application of the vaccine. So far, a law has not been enacted on the obligation of vaccination against Covid, and based on the fundamental rights enshrined in the Dominican Constitution, on personal integrity, if a worker for personal reasons decides not to be vaccinated, the employer cannot fire him under threats.

Using the employer’s coercive power to motivate workers to get vaccinated is not a good idea, so the best solution is to educate and raise awareness among staff so that they access vaccination voluntarily, since what is sought to achieve is to preserve the collective good and maintain the health measures implemented by the authorities.
